'Shanshuiqing' Looks Like 'Ganten' – Sued and Settled for 180,000 Yuan 'Shanshuiqing' purified water sold in the Hainan market was sued by the company owning 'Ganten' mineral water for 'unauthorized use of well-known product's unique packaging and decoration', demanding cessation of infringement and compensation of 2.1 million yuan. Recently, the Second Intermediate People's Court of Hainan successfully mediated this intellectual property dispute, with the defendant paying 180,000 yuan to the plaintiff, and both parties reaching a settlement. The plaintiff, a Shenzhen food and beverage company (hereinafter referred to as Shenzhen Beverage Company), claimed to be the exclusive owner of the registered trademark 'Ganten'. The company's 'Ganten' natural mineral water's unique packaging and decoration were recognized as well-known product's unique packaging and decoration. Since September 2016, the company discovered that 'Shanshuiqing' natural purified water produced by a Danzhou beverage company (hereinafter referred to as Danzhou Beverage Company) was sold in the Hainan market. The bottle packaging and box decoration of the involved product were extremely similar to and easily confused with those of 'Ganten' natural mineral water. To protect its legitimate rights, the company sued the court, requesting the court to order Danzhou Beverage Company to stop infringement, destroy bottles and packaging boxes, and compensate for various losses of 2.1 million yuan. The defendant, Danzhou Beverage Company, argued that in February 2005, it applied to the Trademark Office of the State Administration for Industry and Commerce and obtained the registered trademark 'Shanshuiqing', approved for use on goods (Class 32), including purified water (beverages). In May 2015, a beverage factory in Dongyuan County authorized it to use the beverage bottle appearance patent, and the patent owner confirmed the authorization. In September 2016, it began producing and selling 'Shanshuiqing' natural purified water, with purple-blue plastic bottle packaging, and the bottle cap trademark and bottle label were different from 'Ganten'. Danzhou Beverage Company believed that its products did not cause merchants and consumers to misidentify or confuse, and requested the court to reject the plaintiff's claims. After accepting the case, the collegial panel judges visited the defendant's factory multiple times to understand the case, ascertain the facts, and clarify responsibilities. After considering that the defendant's infringement intent was not obvious, they actively conducted mediation work with both parties. Through mediation, both parties voluntarily and equally reached a mediation agreement: Danzhou Beverage Company paid Shenzhen Beverage Company 180,000 yuan in one lump sum, agreed to change the bottle label shape and color to be clearly distinguishable from the plaintiff's products, and agreed to stop using the involved bottle body from January 1, 2018. Thus, the case was resolved, and both parties shook hands and made peace.
