# Distributors Desperately Await 'Hard-Earned Money'; Budweiser APAC: Deposit Has Nothing to Do with the Company

20 years ago, Mr. Zhang, a city resident, began working in beer promotion. Though not wealthy, his life was comfortable. However, in the past two months, his life has hit a series of hurdles: first his eyes were burned, then he lost his job. Now, in urgent need of money, he remembered the 30,000 yuan deposit he had paid to a primary wholesaler that he has been unable to recover. One blow after another has left this man at a loss.

On April 19, the reporter met Mr. Zhang and heard his story.

Mr. Zhang said that starting around 1996, he picked up beer from the brewery and sold it to supermarkets and restaurants, and business was good. Since 2013, they could no longer pick up beer directly from the manufacturer; they had to get it from a fixed wholesaler.

"In 2014, the wholesaler asked each of us to pay a 30,000 yuan deposit, saying if we didn't, we couldn't continue to pick up beer. They told us the deposit would be refunded when we stopped working." 30,000 yuan is not a small amount. Although hesitant, Mr. Zhang paid after much consideration.

In February this year, a fire broke out at Mr. Zhang's home, and his eyes were accidentally burned, requiring half a month of hospitalization. Mr. Zhang said that when he returned to work in March, the primary wholesaler fined him for not completing his sales tasks, and later he quit.

Later, something happened in Mr. Zhang's hometown. Because he urgently needed money, he repeatedly approached the primary wholesaler to ask for the 30,000 yuan deposit, but it has not been returned.

The reporter saw a receipt in Mr. Zhang's hand, indicating the payment reason as "second-tier distributor deposit," the amount as 30,000 yuan, the entry date as July 22, 2014, and stamped with "Daqing City Sartu District Xuexu Beverage Wholesale."

Puzzled: Besides deductions, there are various fines.

"Normally, for each case of beer we sell, the primary wholesaler gives us a commission, but sometimes we receive less money. At first, we didn't pay much attention, but later the deductions increased." Mr. Zhang said that after resigning, the primary wholesaler settled his commissions for a few months in 2015, but the amounts for June and August were discounted, and for May, he received nothing.

Mr. Zhang told the reporter that each month they had to sell a certain amount of beer. He could understand being deducted for not meeting the quota, "but besides the deductions, I was fined 1,500 yuan in May, 1,000 yuan in June, and 1,200 yuan in January for unmarked beer cases. These fines I find hard to understand." Mr. Zhang said.

"In addition, I have some beer crates deposited there. Now that I've quit, I hope they can return those crates to me. Also, before I got injured this year, I worked there for a month and a half and didn't receive any money." As he spoke, Mr. Zhang took out some slips, which the reporter saw were marked with bottle and crate storage entry forms and quantities.

Primary wholesaler: Deposit to be returned in August.

That day, the reporter accompanied Mr. Zhang to see the primary wholesaler, but the person in charge was not there.

Subsequently, the reporter contacted Ms. Zhai by phone. She said that to prevent second-tier distributors from selling other beers, they collect a deposit from them. If a second-tier distributor stops working, the deposit will be returned after six months. She said that since Mr. Zhang said his family urgently needed money, she had promised to return the money in August.

"Mr. Zhang said he worked there in January and February this year. Why didn't he receive wages?" In response, Ms. Zhai corrected that the money they pay to second-tier distributors is not wages but commissions. The company sets sales targets for them, and they also set targets for second-tier distributors. Because Mr. Zhang did not meet the targets for those two months, he did not receive commissions.

Regarding the fines, Ms. Zhai said that Mr. Zhang was fined only when he violated rules during work, and he agreed to pay at the time. She said she had been very humane and did not fine him for some violations. As for the crates, Ms. Zhai said Mr. Zhang could contact the company.

Beer company: Agrees to mediate.

To clarify the matter, the reporter also visited the Xiaoxue Brewery, now named Budweiser APAC Daqing Brewery Co., Ltd.

After communication with staff, the reporter contacted a manager from the relevant department of Budweiser APAC Daqing Brewery. Regarding the 30,000 yuan deposit, the manager said that the deposit has nothing to do with the company; it is a matter between the primary and second-tier distributors.

The manager said that, as far as he knew, Mr. Zhang picked up beer from the primary wholesaler for promotion, but over the years, his business was not doing well. In March this year, the primary wholesaler talked to him, and he agreed to quit. The primary wholesaler promised to return the deposit within three months. He would also help coordinate the matter as soon as possible.

Regarding Mr. Zhang's complaint that the primary wholesaler discounted payments, the manager said that business work has certain assessment standards. Although he was not clear about the details, he guessed that Mr. Zhang might have had some problems in his work.

Regarding other issues raised by Mr. Zhang, the manager said he would help coordinate, but he also emphasized that if the economic dispute between the wholesalers could not be resolved, Mr. Zhang could file a lawsuit.
